Advocates under occupation: Situation with observing the advocates’ rights in the context of the armed conflict in Ukraine

The presence of an independent legal profession is particularly important under the conditions of occupation and an armed conflict, which includes guaranteeing the rights of lawyers and their professional activities that are indispensable for fair justice. This Report is the first serious attempt to investigate the situation of lawyers and law enforcement agencies in relation to the conflict, and to highlight the issues of prosecution of lawyers, including those happened because of their professional activities in the occupied Crimean peninsula and in Donetsk and Lugansk regions uncontrolled by Ukraine.

The study covers the period 2014-2018 and is based on the information received from the government agencies, the National Bar Association of Ukraine, from Ukrainian and other media, personal and online interviews with lawyers, many of whom wished to remain anonymous.

The report consists of several parts devoted to the basic standards and guarantees of the professional activities of lawyers, the situation with the violation of the rights of lawyers in the zone of an armed conflict and the situation with respect to the rights of lawyers from the occupied territories in the territory controlled by Ukraine. In addition, the recommendations for the National Bar Association of Ukraine, the authorities of Ukraine and the Russian Federation, the structures of the Council of Europe and the UN were set out.
